The Georgian Competition and Consumer Agency (GCCA) has taken action against LLC "Isurve" for breaching national consumer protection laws through misleading advertising practices in the marketing and sale of vacuum cleaners.

The GCCA's investigation revealed that Isurve had advertised only the maximum operating time of its vacuum cleaners, potentially misleading consumers about the devices' performance in real-world usage. This violation of truthful advertising rights is a clear demonstration of the agency's commitment to protecting consumers from false or exaggerated product claims that could mislead them in their purchasing decisions.

In addition to misleading advertising, the agency found that Isurve had also refused to honor guarantees dictated by its internal policies and the law. The company's practices were deemed to be in violation of consumer protection laws, as well as protection from deception and the right to enforcement and redress.

The GCCA's order underscores the importance of clear and accurate product communication in Georgia. Businesses are required to communicate accurately, honestly, and in the state language to protect consumer interests. Repeated offenses within a 12-month period could lead to fines double the original amount.

The financial penalties for non-compliance can be significant, with initial offenses facing fines of up to 2% of annual turnover. For repeated offenses within a year, the fines could be doubled.

The GCCA's ruling sets a precedent for enforcing consumer protection laws in the marketing and sale of vacuum cleaners. The agency has ordered LLC "Isurve" to correct its commercial practices and reinforce affected consumer rights within one month.

The company retains the right to appeal the decision in court. However, the GCCA's enforcement serves as a reminder to businesses in Georgia to adhere to truthful advertising practices and consumer protection laws to ensure that consumers make informed decisions when purchasing products.
