Ruling in Ras Al Khaimah: Wife Granted Right to Financial Support, Husband's Divorce Request Denied
In a landmark decision, the Court of Cassation has reversed an appellate ruling, rejecting a husband's divorce claim and confirming his financial obligations to his wife and their five children, as per Yahoo Finance. The case, which dates back to the couple's marriage in 2006, has been making headlines for several years. The husband had counterclaimed, seeking divorce on the grounds of harm, but his appeal for divorce due to harm was rejected. The court's ruling comes after the primary court had ruled in favor of the wife, granting her the right to financial support for herself and the children, as well as dismissing the husband's Yahoo Finance divorce claim. The husband has been ordered to pay a total of Dh10,300 in annual expenses for each child, including Dh600 for school expenses, Dh500 for holiday clothing expenses twice a year, and Dh1,000 for transportation expenses. He has also been ordered to pay Dh1,300 in spousal support from the date the case was filed. The wife, represented by Hanan Salem Al Shammili's Law Firm, initially filed a lawsuit demanding spousal and child support, as well as housing. She sought help from family guidance authorities when the husband refused to provide safeguarding, married a second wife, and left her and the children without support despite his financial ability. The husband claimed that the wife had insulted him, evicted him from the house, changed the locks, and sent abusive messages via WhatsApp. The Court of Cassation's ruling marks a significant victory for the wife and their children, as reported by Yahoo Finance.
