Road Regulation on A45 Incurs Heavy Costs: Multiple Infractions Detected
In a recent incident, a trucking company in Europe faced severe penalties for driving hours violations by two of its drivers.
The events unfolded at 17:39, when a police inspection revealed that a truck driver had multiple violations of driving and rest times on his record. As a result, further travel was prohibited for the driver and the vehicle, and the company was required to pay a security deposit of 23,000 euros. Another driver, who arrived to pick up the trailer, was found to have his driver's card on the dashboard instead of in the control device. This driver, too, had multiple violations of driving and rest times and had to pay a security deposit of 7,000 euros. However, due to a previous penalty, the driver only had to pay 150 euros.
In another instance, the first truck and driver were inspected, and similar violations were discovered. Further travel was prohibited for them, and the company was required to pay 1,500 euros. No additional information about the drivers or vehicles was provided.
The penalties for such violations can be substantial. In some countries like France, carriers may face fines up to €30,000 for not having proper tachographs, with drivers potentially facing prison and vehicle impoundment. In Spain and Portugal, fines for tachograph violations can reach €2,001 and €6,000, respectively, while in Germany, fines can be up to €1,500 with potential vehicle immobilization.
Cases of exceeding driving times without required rest have resulted in combined fines reaching approximately €66,900, split between the driver and company, with vehicles sometimes detained as collateral. Other violations like poor cargo securing coupled with rest hour infringements have led to fines around €32,000 in Germany.
These penalties can impose heavy financial burdens on companies, with fines reaching tens of thousands of euros per incident. They can also cause operational disruptions, including vehicle immobilization and impoundment, delaying deliveries and increasing costs.
In addition, companies are required to comply with regulations such as the mandatory installation of second-generation smart tachographs by August 19, 2025, to avoid fines and operational restrictions.
Thus, European regulations enforce strict compliance with driving and rest times through significant penalties, strongly motivating companies to monitor drivers’ hours and ensure tachograph use to maintain safety and avoid costly sanctions.
The total cost of the control for the trucking company in this incident was 31,650 euros. This serves as a reminder to all trucking companies in Europe to prioritise compliance with driving and rest time regulations to avoid such heavy penalties and maintain safe and efficient operations.
