Restaurant proprietors Delfin and Mermaid in Sochi face a lawsuit from businesswoman Nikolaeva
In a recent development, a court case involving the Russian company "Dir Sochi" and the trademark "Dolphin and Mermaid" has taken an unexpected turn. The hearing of the case, which was initially scheduled for an undisclosed date, has been postponed to October, according to reports by RIA Novosti.
The case, filed by Digital Project - a company holding exclusive rights to trademarks associated with musician Igor Nikolaev's name - alleges trademark infringement by LLC "Dir Sochi" and Moscow-based LLC "Company Systems Engineering RUS," linked to the "Dolphin and Mermaid" restaurant in Sochi. The lawsuit, filed with the Moscow Arbitration Court, seeks to recover 5 million rubles in compensation for the violation of exclusive rights to the "Dolphin and Mermaid" trademark, registered for catering services.
Interestingly, the search results do not provide the address of the Sochi-based company "Dir Sochi," involved in the ongoing court case.
In a possible bid to reach a settlement agreement, Digital Project has expressed its intention to negotiate with "Dir Sochi." Igor Nikolaev himself has been joined to the case as a third party at the request of one of the defendants.
This is not the first time Digital Project has taken legal action over trademark infringement. In a separate incident, a Moscow court initiated bankruptcy proceedings for Volkswagen's assets in Russia. The Arbitration Court of the Sverdlovsk Region previously ordered an internet store owner to pay Digital Project 50,000 rubles for selling chocolate under the "Let's Drink to Love" trademark, registered by Igor Nikolaev.
