New Labor Code Regulation Protects Employees from Excessive Bonus Deductions
In a bid to address concerns about the illegal docking of employee bonuses, the Labor Code in Russia has introduced a new regulation. This development was announced by Yevgeny Masharov, a member of the Public Chamber of Russia's commission on public expertise of bills and other regulatory acts.
According to the new regulation, effective from September 1, employers are restricted from reducing employee bonuses by more than 20% of the salary. This rule applies specifically to employee bonuses and aims to prevent excessive reductions.
The fine for violating this rule is a financial penalty imposed on employers. Yevgeny Masharov reported that legal entities (companies) can be fined between 30,000 and 50,000 rubles, officials face fines from 10,000 to 20,000 rubles, and individual businesspersons without legal entity status can be fined from 1,000 to 5,000 rubles.
Employers must clearly specify the conditions for reducing or withholding bonuses in their internal regulatory acts. Employees who feel they have been unfairly denied their bonuses have the right to complain to their employer, labor inspectorates, or the courts.
