Hermês faced accusations of intellectual property theft by Skechers, as a dispute erupted regarding comfort footwear technology.

In a recent turn of events, Skechers has filed a lawsuit against luxury fashion brand Hermès, alleging that the French company infringed upon two of Skechers' patents related to hands-free slip-on shoe technology. The patents in question, D965,263 and D925,183, were issued by the United States Patent and Trademark Office.

The lawsuit, filed on Tuesday, claims that the wavy mid- and under-soles of Hermès' Eclair and Envol shoes, released in 2022, infringe upon Skechers' patents. Skechers is seeking a jury trial and unspecified damages.

Hermès, however, has not responded to requests for comment at the time of publication. The Eclair and Envol shoes from Hermès run from around $800 to $940.

It's important to note that this lawsuit is specific to the hands-free shoe technology dispute and does not involve Hermès in any of the other lawsuits that the brand is currently embroiled in, such as the $16 billion share disputes and access to Birkin bags.

Skechers, known for its commitment to research and development, has previously taken legal action against other brands over trademark infringement, including Brooks and Easy Spirit. The company's second-quarter results revealed a quarterly sales record of $1.87 billion, up 12.4% year over year.

Interestingly, four board members departed from Skechers following the involvement of activist investor Tremblant Capital Group, who took a stake in Skechers last year.

On a different note, Hermès' third-quarter earnings showed sales were up 24% based on constant exchange rates. The company's document holder, priced at $10,300, is one of its high-end offerings. Chief Financial Officer Eric du Halgouet announced that Hermès will raise prices higher by 5% to 10% starting in January.

As of now, no publicly available information or patent numbers link Skechers and Hermès in any other lawsuit. The patents related to this dispute were issued by the United States Patent and Trademark Office on Oct. 4, 2022, and July 20, 2021, respectively.
