German Court Bans Organic Logo on Vitamined Beverages

The German Federal Administrative Court has ruled that organic beverages, or 'Biogetränke', produced with added non-plant vitamins and minerals cannot bear the German Biosiegel or the EU Bio Logo. This decision follows a case brought by the company Herbaria, which had labeled one of its mixed drinks with the EU Bio Logo despite the added nutrients.

The court's ruling extends beyond Herbaria's case, applying to all organic beverage producers. It stipulates that not only are these beverages themselves prohibited from bearing the organic seals, but also that any mention of biological production of individual ingredients in the ingredients list is not permitted. This means that producers must clearly indicate the addition of these non-organic components.

Herbaria had appealed the ruling, arguing that they were at a disadvantage compared to US competitors who are allowed to use such labels. However, the court rejected this appeal, upholding the ban on the use of organic seals for such beverages.

The Federal Administrative Court's ruling in Leipzig has clarified the labeling regulations for organic beverages in Germany. Producers must now ensure that their products comply with these rules, and consumers can expect clearer labeling regarding the organic status of their beverages.
