Construction Halt on Single-Family Homes in Stormthal: Higher Administrative Court Issues Temporary Injunction

The Higher Administrative Court of Saxony has brought a halt to the construction of single-family houses in Stormthal, blocking plans that had been underway for some time.

Großpösna - A temporary construction stop has been ordered for single-family homes directly behind the protected Baroque castle in the Großpösna district of Stormthal. This decision comes from the Higher Administrative Court of Saxony (OVG), Bautzen, in response to an urgent application filed by property owner Manfred Kolbe, a former Saxon Minister of Justice.

The castle owner had raised concerns about parts of the development plan for "Stormthal Ortsmitte" since March 24, focusing on new builds immediately adjoining his protected castle walls. In fact, Kolbe initially voiced opposition to the original development plan from 2021, expressing fears about noise conflicts between the use of the castle and the proposed residential and holiday home construction so close to his historic complex.

The town council adopted a revised development plan thereafter, but construction in the contested areas progressed nonetheless.

The court in Bautzen noted that the development plan suffered from "a clear investigative and evaluative error in balancing the noise conflict," necessitating the temporary construction halt due to the applicant’s concern about the potential impairment of the commercial use of his castle in the implementation of the development plan.

Taking into account the economic interests of the project developer, the court temporarily suspended the development plan "only with regard to the new residential and holiday home areas closer to the castle."

A "noise conflict" remains the central point of contention in this issue.

The judges emphasized that the development plan did not address this issue adequately. For reasons of proportionality, they imposed the temporary suspension solely on the residential and holiday home areas closest to the castle.

In separate news, there has been a surge of anti-Semitic incidents in Saxony, with growing reports of violence, threats, and property damage. This disturbing trend has also recently raised concerns about the welfare of Jewish communities in the region.

In addition, skin cancer cases in Saxony have tripled in recent years, presenting a significant public health challenge that authorities are actively addressing. The loss of a local resident, Viktor, after a fatal fall into a tank wagon, has led to an emotional appeal for donations to support his grieving family.
