A Compilation of Biden Regulations Slated for Reversal Swiftly in the 119th Congress
The incoming Trump administration and the 119th Congress are prepared to challenge Biden's last-minute regulations by introducing disapproval resolutions, aiming to revoke these costly rules issued during the last 60 days of the 118th Congress. The Congressional Review Act (CRA) of 1996 serves as the primary tool for this process. Although the CRA has existed for nearly two decades, it wasn't until Trump's first term that it was actively used to eliminate over a dozen Obama-era regulations.
Despite the potential of the CRA, it's important to maintain perspective. While it can cancel rules dating back to around August, this pales in comparison to the more than 3,000 rules published annually. The CRA can contribute to Trump and DOGE's (Department of Government Efficiency) mission of eliminating departments and agencies, privatizing, and devolving powers to states, but it's not a one-size-fits-all solution.
Biden's Influence in Significant Rules
Let's examine the impact that the CRA can have. Among the thousands of annual rules (there were 3233 in 2024, with a federal workday still to go), the CRA focuses on major rules, which typically represent $100 million in annual economic effects. It's important to note that rules don't need to be officially declared major to affect smaller entities like small businesses and state and local governments in a significant way.
A recent development of importance to the incoming Congress is the surge in major rules as revealed by the semi-annual "Unified Agenda of Regulatory and Deregulatory Actions". In 2024, there were 146 major rules in the combined Spring/Fall Agendas, a significant jump from the 91 major rules in 2023.
Biden's election-year efforts to safeguard his legacy played a role in this surge, particularly the 97-rule surge in Spring 2024. This surge included:
- additional energy conservation standards;
- prescription drug advertisement regulations;
- changes to independent contractor classification;
- vehicle-to-vehicle communication protocols;
- drinking water contamination standards;
- credit card late-fees;
- and increased fuel economy standards forcing adoption of electric vehicles.
These and other costly rules are likely safe within the 60-day window of the CRA, so legal challenges and time-consuming rewrites will become the main avenues for addressing them.
A Strategic Approach
The December 13 release of the Fall Unified Agenda provides Congress with new targets vulnerable to the CRA. With only three weeks left, Biden has an opportunity to issue more rules, knowing that not everything will be axed by overloading the system. This is why Rep. Andy Biggs' (R-Arizona) "Midnight Rules Relief Act" could be a significant solution, enabling bulk repeals instead of the current rule-by-rule process.
This article provides an outline and inventory of CRA targets, complementing Trump's announced campaigns such as a "one-in, ten-out" policy for significant new rulemakings, accelerated permitting, cryptocurrency legitimization, and of course — drilling, baby, drilling.
Managing Active and Long-term Rules: The Unified Agenda categorizes work-in-process rules as "active". These pre-rule, proposed, and final rulemakings can be temporarily frozen or stricken altogether, common practice when administrations change. The Fall Agenda reveals 2,233 active rules, of which 137 are major and another 698 are significant. The Federal Register lists 1,761 proposed rules, 174 of them deemed significant.
This pause is crucial since hefty new Biden administration proposals could offset regulatory savings gained in the coming months if civil-service inspired strategic hibernation is allowed. Biden often teased the GOP, confident it would retain — Obamacare-style — and sometimes even vote for interventions like credit card rate regulation, certain drug-price regulation, remote vehicle immobilization for impaired driving, cutting nicotine, banning dry cleaning chemicals, and implementing Airline Passenger Rights, to name a few.
Rules designated "long-term" in the Agenda should be closely monitored, as at times some have been finalized in a subsequent Agenda. In the Spring Agenda, there were 42 long-term major rules, which have now grown to 77. This significant increase may be due to rules that a second Biden term might have fast-tracked but are now at risk if issued.
Dealing with Completed Rules: Safe rules require court challenges or cumbersome rewrites, but some major rules from the Spring Agenda may still be vulnerable. However, any Biden rules completed from now on are vulnerable to overturn, along with most of the 49 Fall Agenda major rules (as shown in the chart above) and hundreds of other rules that fall within the CRA window. Finalized rules can be monitored in the daily Federal Register, with special attention to the "significant" subset. Among the 49 major rules in the Fall Agenda, we find:
- additional energy conservation standards;
- an automatic emergency-braking rule for vehicles;
- additional vehicle fuel-economy rulemaking;
- regulation of customer reviews on websites;
- a rule on methane-release charges;
- and a "Building for the Future Through Electric Regional Transmission Planning and Cost Allocation and Generator Interconnection" rule.
At the end of this article, I've compiled a detailed list of all the 146 significant regulations completed under the 2024 Agendas. The 97 regulations from the Spring Agenda should be safe, given the 60-day window. The George Washington University Regulatory Studies Center's Congressional Review Act Window Exploratory Dashboard allows users to examine the eligible regulations that can be overturned in 2025. Please note that these regulations, listed in the appendix, are major ones recognized as such by agencies and/or the White House Office of Management and Budget. Nevertheless, non-major regulations can also be subject to the Congressional Review Act.
Another Bite at the Apple
Lawmakers should not consider controversial major regulations completed before the 60-day window as untouchable. Besides the legal challenges and rewrites, the Congressional Review Act necessitates that agencies submit regulations to the Government Accountability Office and both chambers of Congress. Major regulations require specific reports by the GAO, which it archives. Historically, some regulations fail to get properly submitted, and not all major regulations have accompanying reports. Failure to comply with these steps might serve as grounds for contesting certain regulations' validity, should Trump and Congress raise the issue.
Onward
Although the Congressional Review Act is vital for regulatory rollbacks, it is not a cure-all. Most eligible regulations will remain unchanged, stressing the need for additional tools, oversight, and structural reforms, such as terminating agencies and programs. One crucial step would be switching from CRA-style disapproval to mandatory congressional approval for all significant or controversial regulations. Another would be expanding work on preventing the laundering of regulations through guidance documents and policy statements, a problem addressed in the past by former and incoming Office of Management and Budget Director Russell Vought.
